GOAL
Provide the users of the recording system in our counties
standardization for the recording and collection of fees for instruments
submitted for recording.
We realize that not all inconsistencies have been resolved
and that changes and additions to these standards will need to be made. Updates will be made as new instrument titles
are identified and new procedures are developed to standardize the way we
record instruments. For procedures not
addressed in this document you should assume that the procedure has not changed
and that it may be different from county to county. You should contact your

This section lists instrument titles in alphabetical
order. You will also find additional
information about the instrument and, in some cases, a statement indicating
that a reference was not found that requires or allows recording. Effective October 23, 1999
we will no longer record instruments that are identified as “REFERENCE NOT FOUND” unless statutory authority or other
laws that require or permit recording can be determined. In addition you will find three columns that
relate to if fees are charged on a particular instrument. The first column being for
the $10.00 Assessment and Taxation Fund fee and $1.00 for the Oregon Land
Information System Fee. Second column for the Public Land Corner Preservation Fund fee, and
third for Washington County Transfer Tax (see notes below). A “Y” in a column indicates that the
corresponding fee will be charged; an “N” indicates the fee will not be
charged. If either the “Y” or “N” has a
number beside it, refer to the “Instrument Title Numbered Footnotes” section
for further clarification. In addition
to these fees the standard recording fee of $5.00 per page applies.
Note: The Public Land Corner Preservation Fund fee is set
by each county and varies from $0.00 to $10.00,
however it will be applied to the same instruments. The fees for each county are listed at the
top of each page in Section B.

Section A
General
Recording Procedures
The County Assessment & Taxation Fund fee does not apply to recording of;
· Evidence of authority to solemnize marriages under ORS Chapter 106.
· Instruments that are otherwise exempt from recording or filing fees under any provision of law.
· Satisfaction of judgment or certificate of satisfaction of judgment.
· Internal county government instruments not otherwise charged a recording or filing fee.
· Instruments that list the grantor or grantee as a federal agency. (The fee does apply to other government agencies).
If the instrument submitted to the recorder is filed and not charged a recording fee then it would not be subject to this fee.
County Recorders Process for
Determining if An Instrument is Recordable
The county recorder receiving a instrument for recording will take the following steps to determine if the instrument is recordable.
1. Check available resources to determine if it is required or permitted by state law or rule or federal law or regulation to be recorded. Typically this will be done by checking to see if it is listed in Section B of these standards as having a reference were it is required or permitted to be recorded.

Instruments rejected for lack of authority to record may be submitted for recording with documentation that requires or permits by state law or rule or federal law or regulation the recording of the instrument. Documentation that the instrument is recognized under state law or rule or federal law or regulation as affecting title to or an interest in real property. Documentation will be reviewed by recording staff and may be forward to county counsel for review and determination of recordability.
You may wish to review Section B before submitting your instruments for recording to determine if they will be easily recognized by the county recorder. You may wish to provide documentation at time of recording if you feel that the document will not be recognized easily by the county recorder as being required or permitted to be recorded.
Federal Tax Liens (Uniform Federal Tax Lien Registration Act)
Oregon revised statute 87.806(3) states, “After October 15, 1983, notices of federal liens upon personal property, whether tangible or intangible, for obligations payable to the United States and certificates and notices affecting the liens shall be filed in the office of the Secretary of State.”
Fees
A $5.00 per page fee is charged on all instruments presented for recording. “Per page” is interpreted to mean
“per side “ of a sheet no larger then 81/2 inches by 14 inches.
If appropriate fees are NOT submitted at time of recording the instrument(s) will be rejected.
Instrument Titles and
Multiple Transactions
Interpretation of clearly titled Instrument title or titles must be on the first page and each title distinguishable so that the public in general can look at the instrument and identify the instrument title or titles. We recommend that large bold type of the same size and style be used at the top of the first page and that each instrument title contained in the instrument be put on a separate line.
· If the instrument contains more than one recordable instrument title and is not clearly titled as defined above, the instrument may be considered to be not clearly titled and therefore, charged a non-standard instrument fee.
· Titles that are on the same line and are recordable as separate instruments and not distinguishable from one another in such a way the public can identify the titles may be considered not clearly titled and therefore, charged a non-standard instrument fee.
· Instruments that are not clearly titled, such as an instrument entitled “Deed” but then state in the body of the instrument that the “Deed” is given for security purposes only, may be considered to be not clearly titled and charged a non-standard instrument fee.
· For recording purposes, ( ) around text after an instrument title, will indicate that the text is not part of the instrument title and will not be indexed.
All non-standard instruments will
be charged a non-standard instrument fee in addition to all other applicable
fees.
Interpretation of addendum, rider, and/or exhibit Any attachment to a recordable instrument that is clearly marked “RIDER”, “ADDENDUM”, and/or “EXHIBIT”.
Riders, addendums and/or exhibits will not be charged an additional transaction fee and will not be indexed.
Interpretation of transaction Any instrument title that is required or permitted by law to be recorded. See SECTION B for list of potential titles.
Each instrument shall have at least one instrument title (transaction). Each additional transaction will be charged a multiple transaction fee.
If additional transactions are found within the instrument and are not included as part of the instrument title a non-standard instrument fee will be charged in addition to all other fees.
Each transaction will be indexed in the same manner as if recorded as a separate instrument.
Legibility Requirements
The intent of this
section is to explain why there are legibility requirements for recording
instruments in county recording office’s and to provide information on how to
avoid rejections of instruments due to legibility problems.
In accordance with
state laws, the county recording office must maintain a reputation for the
recording and storage of recorded instruments in a fair and open manner. Recordation of an instrument makes it a
public record and puts the public on notice.
Since the public and courts may use the recorded instruments to establish
validity of claims, all pages must be readable.
The Property Records Industry Joint Task Force
adopted on March 2, 2000 a White Paper on “Real Estate Document
Formatting”. Copies are available at the

are considering revising
or making new forms to record in a county clerks
office we recommend that you follow the recommendations from the task
force. This will help insure that the
document will not get rejected because of legibility and formatting issues.
General
Legibility Information
- If the legibility
of an instrument or notary seal is questionable and a deadline may be
compromised should the county recorder reject the instrument, we suggest that
you correct or prepare a new, legible original prior to submitting it for
recording. We understand that fixing or
preparing a new original may not always be possible due to client demands;
however, the client should be informed beforehand that the legibility problem
exists and may cause the instrument(s) to be rejected, prolonging the delay.
-If an instrument
is illegible, a legible true copy may be attached to the original per ORS
205.135. The attached legible true copy
should state that “This is a true copy of ______ as per ORS 205.135 and is
attached for legibility purposes."
- If it is your
opinion that the illegible information on the instrument presented for
recording is either unimportant or unnecessary, you may want to consider
removing it. Check with your legal counsel prior to doing so. The information may be required.
- At the discretion
of the county recorder an instrument may be recorded that contains information
that is illegible if such information was previously recorded in a legible
manor and made a permanent public record of a governmental body. The illegible instrument may be recorded by
making reference to the original file or recording number and stating where the
original record is on file and any other information that the county recorder
may require.
-Signatures and
notaries must be original; photocopies cannot be recorded. Notary seals must not cover any text on
certificate or instrument.
-Documents
submitted for recording shall be in the English
language. see

-Marking of any
text with a highlighter on an instrument will not be accepted in Clackamas or
Common
Legibility Problems
1.
Text smaller than 8 point.
Enlarge original or prepare a new original with larger text.
2. Colored
Text on colored paper, example blue NCR paper with blue text. Copy original on white paper with black text
or prepare a new original.
3. Text
that is light, blurred, contrasting light and dark,
heavy and filled in, typed through a line.
Prepare a new original.
4. Large
documents reduced to smaller size.
Replace with full or larger size copy that has legible text. Any size document may be recorded. The recording fee for a page larger than 81/2
inches by 14 inches is $20.00 plus $5.00 for each 81/2 inch by 14 inch page
that it will make.
5. Dark
colored paper. Prepare a new
original.
6. Light
or blurred carbon or NCR copy.
Prepare a new Original.
7. One
page of an instrument made up of two different colors of paper. Photo copy original on white paper with black
text or prepare a new original.
Non-Standard Form Fee
A $20.00 non-standard fee is added in addition to all other fees to instruments that do not meet the requirements as outlined in ORS 205.232, 205.234, 205.327.
The Oregon Land Information System Fund (established 1-1-2000) fee does not apply to recording;

Oregon County Clerks
& Recorders will accept the national UCC Financing Statement form; however,
this form may not meet
The following items are required on the first page of each financing statement or amendment:
1. Name of the transaction.
2. Name of parties and their designations (e.g., debtor: John Jones, Secured party: US Bank NA)
3. Name of Property owner if different from debtor.
4. Name and address of party to whom the document will be returned; must be preceded by “Return To:”
National UCC forms
include a second page titled “Addendum”
which may be necessary to your filing.
Forms that include more than one transaction (e.g., both the amendment
box and the continuation box are checked), will be charged an additional $5.00 multiple-transaction fee.
A UCC Financing
Statement filed as a fixture filing under ORS 79.3130 shall be recorded and
indexed as a mortgage on real property.
It shall conform to the requirements of ORS 79.4020(5) and describe the
property as in the manner prescribed in Chapter 93 for a mortgage. Box 6
on the initial filing form or Box 1b
on the amendment form are required to be checked per UCC Financing Statement
instructions if it is to be recorded in the real estate records. If either of these boxes is left unmarked,
the form may be rejected.
All filing information must be legible or the form will be rejected. Filing information must be in 8 point type or larger or a $20.00 non-standard fee will apply in addition to all other applicable fees.
Washington County
Transfer Tax is not charged when government body is designated as grantor or
grantee.

The words “discharge” and “exemption” in an instrument title will be interpreted as “releases” and “satisfactions”.
The word “assumption” in an instrument title will be interpreted as an “assignment”.
The words “addendum”, “extension”, “memorandum”, “subordination”, “substitution”, and “supplemental” in an instrument title will be interpreted as “amendments” and “modifications”.
The following words will not be considered as falling within ORS 205.130(3)(d);
“canceling”, “cancellation”,
“intent to forfeit”, “recession”, “reinstating”, “rescind”, “resignation”,
“resignation and appointment”, and “waiver”.
